Terms of Service

1. Engagement Agreement

Affluent Care Concierge ("ACC") provides exclusive in-home counseling and mental wellness services to high-net-worth individuals, executives, and public figures. All engagements are:

  • Private and confidential — Limited to the client, family members authorized by the client, and ACC clinical staff
  • Referral-based — Clients are accepted only through professional intermediaries (attorneys, physicians, wealth advisors)
  • Time-bound — Programs range from 7 to 31 days with clearly defined scope and objectives
  • Non-transferable — Services are provided exclusively to the named client and cannot be assigned or transferred

2. Service Scope & Limitations

ACC services include clinical assessment, in-home stabilization, family coordination, and transition planning. Services are not intended to:

  • • Replace hospitalization or emergency psychiatric care when medically necessary
  • • Provide ongoing outpatient therapy (post-engagement referrals are provided)
  • • Guarantee specific clinical outcomes or cure mental health conditions
  • • Serve as a substitute for medical treatment or medication management by licensed physicians

ACC clinicians will immediately refer clients to emergency services if acute medical or psychiatric crisis is identified.

3. Program Duration & Cancellation

Minimum Engagement: 7 days. Programs are customized within the 7–31 day range based on clinical assessment and family agreement.

Cancellation Policy: Cancellations must be communicated in writing to ACC clinical leadership. Cancellations within 48 hours of program start incur a 50% service fee. Cancellations after program commencement are non-refundable.

Early Termination: If a client requests early termination after program commencement, ACC will provide transition support and referrals. Full fees remain due.

4. Client Responsibilities

By engaging ACC services, clients agree to:

  • • Provide accurate medical, psychiatric, and family history information
  • • Disclose all current medications and substance use
  • • Participate actively and in good faith in the treatment process
  • • Maintain safe and secure residential accommodations for clinician access
  • • Comply with clinical recommendations and safety protocols
  • • Notify ACC immediately of any medical or psychiatric emergencies

5. Confidentiality & Privacy

ACC maintains strict confidentiality in accordance with HIPAA regulations and state mental health privacy laws. Client information will not be disclosed to third parties except:

  • • With explicit written consent from the client
  • • When required by law or court order
  • • In emergency situations where disclosure is necessary to protect health or safety
  • • To family members or advisors designated by the client in writing

ACC does not advertise client names, participate in testimonials, or disclose engagement details publicly under any circumstances.

6. Fees & Payment

Service fees are determined based on program duration, clinical intensity, and family coordination requirements. Fees are invoiced upon engagement agreement and are due prior to program commencement.

Payment Methods: Wire transfer, ACH, or certified check. ACC does not accept insurance billing or institutional payment channels.

Travel & Accommodation: Client is responsible for all travel, accommodation, and meal expenses for ACC clinical staff during engagement.

7. Liability & Indemnification

ACC provides clinical services in good faith based on professional standards of care. However, ACC does not guarantee specific outcomes and is not liable for:

  • • Indirect or consequential damages arising from engagement
  • • Client decisions made after ACC engagement concludes
  • • Third-party actions or events outside ACC control
  • • Complications arising from undisclosed medical or psychiatric conditions

Client agrees to indemnify and hold ACC harmless from any claims, damages, or legal proceedings arising from client's misrepresentation or non-disclosure of material information.

8. Dispute Resolution

Any disputes arising from this agreement shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. Arbitration shall take place in the jurisdiction where ACC is headquartered.

Client waives the right to pursue litigation in court and agrees to resolve all disputes through confidential arbitration.

9. Modifications & Amendments

ACC reserves the right to modify these Terms of Service at any time. Material changes will be communicated to active clients in writing. Continued engagement after modification constitutes acceptance of updated terms.

10. Governing Law

These Terms of Service are governed by the laws of the state where ACC is headquartered, without regard to conflict of law principles.

15. SMS Communication Consent
